ACM is obliged to publish the decision in which it refrains from imposing a fine 2560 1096 SarisLaw

The Act establishing the Netherlands Authority for Consumers & Markets (Act) obliges the ACM to publish a decision in which a serious infringement (such as infringement of the prohibition on cartels) has been established, but in which the imposition of a fine was abandoned. The Trade and Industry Appeals Tribunal considers such a decision to be a decision to impose an administrative penalty within the meaning of Article 12v of the Act. This was ruled by the Tribunal in its judgment of 18 February 2020 (ECLI:NL:CBB:2020:92).
