Fine overthrown: amount of fine in municipal Housing Bylaw is in breach of the law 1000 667 SarisLaw

On 13 June 2018, the Administrative Jurisdiction Division issued an important ruling for the practice of fines. In that case, the Division ruled that there was no basis for imposing a fine for violating the Housing Act 2014. The municipality of Tilburg had acted contrary to the Housing Act by not setting specific amounts of the fines for various violations of the Act in its Housing Bylaw. Setting one amount of the fine for various violations in the municipal housing bylaw does not comply with the Act. In view of this, the imposed fine is null and void.
