On 25 May 2018, the General Data Protection Regulation (GDPR) will enter into force. The regulation has direct effect in the Dutch legal system. As a result, the Dutch privacy watchdog, the Dutch Data Protection Authority, can use a range of enforcement tools under the GDPR to promote compliance with privacy laws. The Dutch Senate is currently debating the General Data Protection Regulation (Implementation) Act (UAVG). The UAVG is intended to enter into force on 25 May 2018 as well. The UAVG further implements the GDPR, which in some aspects leaves room for Member States to regulate certain aspects in more detail. In addition to and in implementation of the GDPR, the UAVG contains, among other things, a number of important regulations pertaining to enforcement.
